Terms and Conditions for BASI Pilates Studio – Winterthur
The terms “BASI Pilates Studio – Winterthur”, “Instructor”, “Trainer”, “we”, “our” or “us” are used in reference to the studio owned and operated by Flower Mountain GmbH. This definition includes but is not limited to the use of BASI Pilates Studio – Winterthur (Sulzerallee 61, 8404, Winterthur) facilities, website and the purchase / use of our related goods and services.
The term “Client” refers to a person who trains at / with BASI Pilates Studio – Winterthur, under a contract (e.g. By booking Single Sessions, Multiple Sessions, Group Sessions, Duet Sessions, Private Sessions or Workshops) entered into by either themselves or a third party.
Training / Sessions / Classes refer to the individual Sessions which the Clients attend. The present Terms and Conditions apply to all contracts between BASI Pilates Studio - Winterthur and a Client or on behalf of a Client and bind both the Client and any third-party contractual partner.
By participating in Training / Sessions at BASI Pilates Studio - Winterthur, the Client agrees to abide by these Terms and Conditions. If any of the clauses in this agreement, either stated here or referred to, become illegal or unenforceable, the remaining terms will still be valid, until replaced by another written agreement.
1. Booking, Payments, and “Abonnements”:
The fees for our services can be found on our website www.basipilatesstudiowinterthur.com. All Training Sessions must be booked in advance through our official channels. Payment is required at the time of booking, and payment fees are non-refundable, non-transferable and non-exchangeable. All memberships, “abonnements” and packages have expiration dates, and unused Sessions will be forfeited after expiration. We reserve the right to change the price of any service at any time.
2. Cancellation Policy:
Private / Duet Sessions and Group Sessions must be cancelled by the Client at least 24 hours and 12 hours before the Session, respectively. If the Client cancels later the full price will be charged. Group Classes must be cancelled through the SportsNow booking system. Private and Duet Classes may be cancelled through the SportsNow booking system or via email at winterthur@basipilatesstudio.com
3. Health and Safety:
The Client must disclose any health concerns or medical conditions before starting Pilates Sessions. This includes but is not limited to current pregnancy and up to 6 months post-natal. Moreover, the Client confirms that no physician / doctor has advised against engaging in any activities necessary for participation in Training / Sessions. Clients with any conditions of concern should not take part in group classes, instead the Client may attend a private class (provided they have received permission to train from their physician / doctor). The Pilates studio reserves the right to refuse service if a Client's health condition poses a risk during the session.
4. Liability Waiver:
The Client acknowledges that participation in Training / Sessions involves physical activity, and the Client assumes all associated risks. BASI Pilates Studio - Winterthur and its instructors are not liable for any injuries, illnesses or accidents that may occur during Training / Sessions.
Excepted are obligatory liabilities under Swiss law.
The Client is responsible for accident insurance coverage. By entering this contract, the Client attests that there are no health-related issues that would contraindicate participating in training. If any such issues should arise during the contract period, the instructor is to be informed immediately.
BASI Pilates Studio – Winterthur Pilates equipment may only be used in conjunction with Sessions / Classes according to instructions given by the Instructor. The equipment is to be handled with due care. The Client is liable for any damages which occur because of their negligent use.
BASI Pilates Studio - Winterthur is not liable for the loss of the Clients’ property. BASI Pilates Studio - Winterthur further excludes any liability on the part of themselves or any of their Trainers / Instructors / Assistants for any damage to person, property, or assets of the Client or third parties while using BASI Pilates Studio - Winterthur facilities, or for which liability might be sought on any other contractual or legal basis.
5. Studio Policies:
We reserve the right to update or modify studio policies and Terms and Conditions. The Client will be notified of any changes through our official communication channels.
In case of illness, accidents, emergencies, or less than 3 participants for a group class, the Trainer retains the right to cancel scheduled training or arrange a replacement trainer to teach the class. In the event of a cancellation, the Client will receive notification via email or phone. Applicable training credits for the affected class will be promptly refunded.
6. Privacy:
Client information will be treated confidentially and will not be shared with third parties without explicit consent.
7. Governing Law:
The contractual relationship between the Client and BASI Pilates Studio – Winterthur is subject to Swiss Law. Any disputes will be resolved in accordance with Swiss law. The exclusive jurisdiction is Winterthur.
